Online Store Regulations
1. Entrepreneur, contact
1.1. The entity operating the online store via the Internet, operating at https://agnostic.pl/ is Agnostic Sp. z OO with its registered office in Warsaw, ul. Mokotowska 63, unit U4 (hereinafter referred to as: "Agnostic"), entered into the National Court Register by the District Court, XIIth Division of the National Court Register of the District Court for the capital city of Warsaw under the KRS number: 0001000672, REGON: 523579140, NIP: 7011112976, share capital PLN 5,000, fully paid up.
1.2. The customer may contact the online store operator in any of the following ways:

- by phone at the hotline number: 798 474 330
- via e-mail to: agnostic.warsaw@gmail.com
- via the "chat" option visible after opening the online store website.
2. General rules for using the Agnostic.pl online store 2.1. The online store may only be used by persons over 18 years of age.
2.2. Persons registering in the online store and making purchases there provide their personal data, which Agnostic processes in accordance with the principles set out in the Privacy Policy.
3. Ordering goods
3.1. Orders are accepted via the website www.agnostic.pl
3.2. Goods in the online store are clearly marked. The website contains, among other things, information about the product's characteristics and price. 3.3. When ordering goods, the Customer selects them in a manner appropriate for the given item, specifying in particular the size, color, and, if necessary, other specific information and the number of items ordered.
4. How to buy in the online store – detailed instructions
4.1. After the Customer selects the product, click the "Add to Cart" icon.
4.2. The product is moved to the shopping cart, which is visible after clicking on the shopping cart icon in the bar at the top of the page.
4.3. After selecting the "Checkout" option, a page will open where you must enter the Customer's data necessary to complete the transaction and ship the ordered goods.
4.4. After selecting the delivery method and entering all required data (including billing information, if applicable), select the payment method. In justified cases, Agnostic may limit the Customer's access to certain payment methods, but this will not affect the Customer's ability to conclude a contract or make purchases in the online store.
4.5. The customer can choose an online payment method (payment by card or via Przelewy24).
4.6. The customer places orders by clicking the "Pay now" button.
4.7. After clicking the "Pay now" button, and if the Customer has chosen online payment, after making the payment via Przelewy24, the Customer is redirected to the order confirmation page, from which they can continue shopping or proceed to the order summary.
4.8. If you choose online payment (card payment or payment via Przelewy24), the payment instruction must be completed immediately after placing the order. If payment is not received, the order is not considered properly placed, meaning the contract is void and the order will not be fulfilled. In such a situation, you must place a new order.
4.9. At any stage of the order process, until payment is made, you can cancel the order by discontinuing the next steps and exiting the ordering page. Any order that is not completed by the Customer will not be processed.
4.10. Immediately after placing an order, an email confirming the order will be sent to the Customer's email address provided in the login details.

4.11. Agnostic may contact the Customer at the e-mail address provided by the Customer or by telephone at the telephone number provided by the Customer in order to clarify any doubts, confirm the order or in any other matters related to the execution of the order.
5. Prices
5.1. Prices on the online store website given in Polish zloty are gross prices, including VAT.
5.2. The price of the goods includes the cost of shipping, the amount of which depends on the chosen method of delivery and payment.
5.3. The price listed on the website at the time of order placement is the final price, binding on both the Customer and Agnostic. Once the order is placed, the price of the ordered goods will not change, regardless of any price changes introduced by Agnostic or any promotional or sale campaigns.
5.4. Agnostic reserves the right to change the prices of goods available in the online store, introduce new goods for sale, conduct and cancel promotional campaigns on the store's website, or make changes thereto in accordance with the provisions of the Civil Code and other legal provisions.
6. Availability of ordered goods
6.1. All goods offered in the online store are available goods.
6.2. In exceptional circumstances, such as multiple customers placing simultaneous orders for the same product, the product may be unavailable. In such cases, the customer will be informed that the order cannot be fulfilled.
6.3. Full size information is available on the product page. A product in an unavailable size cannot be added to the cart.
7. Inability to complete the order
If a particular item is out of stock or the order cannot be fulfilled for another reason, the Customer will be notified by email or phone. In particularly justified cases, Agnostic may refuse to conclude a sales contract to protect its assets.
8. Delivery method and order processing time
8.1. Goods are delivered only within Poland.
8.2. If you choose one of the online payment methods (Card or Przelewy24), the order will be processed after confirmation of receipt of payment for the ordered goods.
8.3. If the selected product is available and the Customer has selected delivery to a specified address, the delivery time is 3 to 6 business days from the date the order is successfully placed. 8.4. Delivery times may be extended during sales or special promotions.
8.5. NOTE: If you choose one of the online payments as your payment method (card or Przelewy24), order processing begins after receipt of 100% of the order amount, and the time limit for delivery of the goods to the Customer is calculated from this moment.
8.6. Orders are delivered by the courier company InPost.
9. Payment methods for orders
9.1. Transfer: Only so-called quick transfers are available, made using the service selected by the Customer from one of Agnostic's partners. After making a selection, the Customer is securely redirected to the website of their chosen payment operator, and then, from the operator's website, to the website of the bank selected from the list, in order to transfer the money. The payment transaction is carried out between the Customer and the selected payment operator.
9.2. Agnostic does not accept traditional transfers, so the Customer will not receive an account number to which payment should be made, e.g. at the post office.
9.3. In order to offer you deferred payment methods, we may transfer your personal data, such as contact details and order details, to companies that provide these services during the purchase process, so that they can assess your eligibility for the deferred payment methods offered and tailor these methods to you. Your personal data is processed in accordance with the privacy policy of your chosen payment provider, i.e., the Przelewy24 privacy policy.
9.4. Payment card: if the Customer holds a card that allows online payments (please check with the issuing bank to determine whether the card meets this requirement). Payment by card is made through the Agnostic partner selected by the Customer. The payment transaction is concluded between the Customer and the cardholder.
9.5. Please note! The Online Store will never send a message to the Customer informing them that their payment account has changed, along with a request to make a traditional transfer. If the Customer receives such an email, they should not make a payment or respond to it. They should forward the unchanged email to Agnostic at: agnostic.warsaw@gmail.com.
10. Sales Agreement
10.1. The information posted on the store's website www.agnostic.pl does not constitute an offer to conclude a contract within the meaning of the provisions of the Civil Code, which means, among other things, that Agnostic may refuse to conclude a contract in particularly justified cases.
10.2. The contract is concluded in Polish.
11. Execution of the contract – deadline
Depending on the delivery option selected by the Customer (to a parcel locker or home), Agnostic undertakes to deliver the goods to the Customer within two business days of the order being placed. If the goods are unavailable or the order cannot be fulfilled for another reason, Agnostic will immediately contact the Customer and propose possible solutions. Business days are counted from Monday to Friday, excluding public holidays.
12. Shipping costs
12.1. Deliveries are made only within Poland.
12.2. The delivery cost depends on the chosen delivery and payment method and is as follows:
- in the case of standard courier delivery and online payment – PLN 16.99 gross;
- in the case of shipment to a parcel locker and online payment – PLN 16.99 gross.
13. Withdrawal from the contract
13.1. The customer has the right to withdraw from the sales contract without giving any reason.
13.2. The right to withdraw from the contract expires after 365 days from the date on which the Customer came into possession of the goods or on which a third party other than the carrier and indicated by the Customer came into possession of the goods.
13.3. To exercise the right of withdrawal, the Customer shall submit to Agnostic an unequivocal declaration of withdrawal from the contract in one of the following ways:

Please note! Each method of sending the declaration is permissible and all are equally effective. 13.4. To meet the deadline for withdrawing from the sales contract, it is sufficient for the Customer to send information regarding the exercise of the Customer's right of withdrawal before the expiry of the 365-day period referred to in point 13.2 above.
13.5. In the event of withdrawal from the sales contract, Agnostic shall refund to the Customer all payments received, including the costs of delivery of the goods (with the exception of additional costs resulting from the Customer's choice of a delivery method other than the cheapest standard delivery method offered by Agnostic), no later than 14 days from the day on which Agnostic was informed of the Customer's decision to exercise the right to withdraw from the sales contract.
13.6. Refunds will be made using the same payment method used by the Customer in the original transaction, unless the Customer expressly agrees otherwise. For example, in the case of a return to a brick-and-mortar store, the seller may offer a cash refund, which the Customer may, but is not required to, agree to. In any case, the Customer will not incur any fees for a refund using a method other than the method of payment for the goods.
13.7. Agnostic may withhold reimbursement until the returned item has been received and inspected.
13.8. The items must be returned to the following address: Agnostic Sp. z OO Mokotowska 63/4, Warsaw 00-533, immediately, and in any event no later than 14 days from the date on which the Customer informed Agnostic of the withdrawal from the sales contract. The deadline is met if the Customer sends the items back before the expiry of the 14-day period.
13.9. The return of the goods may be made at the Customer's expense, at their own discretion, or through a carrier designated by Agnostic, at Agnostic's expense. To use the return option at Agnostic's expense, contact Agnostic by email or post. If the goods are not returned to the Carrier by the deadline, the Customer loses the right to return the goods at LPP's expense.

13.11. The Customer is responsible for any reduction in the value of the item resulting from its use in a manner other than necessary to establish the nature, characteristics and functioning of the item.
14. Complaints
14.1. The sale covers new products, in condition suitable for their intended use. Agnostic is responsible for the conformity of the goods with the contract.
14.2. Any item purchased in the Agnostic online store may be subject to a complaint if the Customer finds that it is inconsistent with the contract, if this non-compliance becomes apparent within two years of its delivery to the Customer.
14.3. The Customer may request that the advertised item be repaired or replaced with a new item that complies with the contract. If the method chosen by the Customer to bring the item into conformity with the contract proves impossible or involves excessive costs for Agnostic, Agnostic may bring the item into conformity with the contract by repairing it in lieu of replacement or by replacing it in lieu of the repair requested by the Customer.
14.4. If both the repair and replacement of the goods prove ineffective, the Customer may submit a declaration of withdrawal from the contract or request a reduction in the price of the complained goods.
14.5. For the Customer's convenience, Agnostic offers, in addition to the rights indicated in point 14.3, the possibility of withdrawing from the contract as a third, additional Customer right related to the nonconformity of the goods with the contract, which can be reported upon the first complaint. The Customer may exercise the right of withdrawal within two years from the date of delivery of the goods. This provision does not affect the consumer's statutory rights related to the nonconformity of the goods with the contract.
14.6. Complaints can be submitted at the Agnostic stationary showroom operating at: Mokotowska 63/4, Warsaw 00-533.
14.7. In the case of a complaint by post, the reason for the complaint must be indicated and information necessary to identify the order. 14.8. Agnostic allows Customers submitting a complaint to return the defective goods by courier at Agnostic's expense.
14.9. Agnostic will consider the complaint within 14 days and inform the Customer about the procedure for its resolution via e-mail or text message.
14.10. If a complaint submitted by post is accepted, the Customer will receive a refund for the goods and a refund of the incurred, intentional costs of sending the defective goods to the e-shop – after sending a copy/scan of proof of their incurrence to the e-mail address: agnostic.warsaw@gmail.com.
14.11. If a complaint submitted to an Agnostic salon is accepted, the amount due to the Customer, along with any applicable refund, will be refunded to the Customer at the salon where the complaint was submitted.
14.12. If a complaint sent by post or Agnostic courier is rejected, the Customer will receive information about the reasons for rejection to the email address provided in the order and the goods will be returned to the address from which the complaint was sent.
14.13. If a complaint submitted at a brick-and-mortar store is rejected, the Customer will be informed of this by e-mail or text message, depending on the Customer's choice, and is obliged to collect the goods at the store where the complaint was submitted within 14 days of receiving the notification.
15. Issuing an invoice
15.1. In the event of a request for an invoice, the Customer shall provide the necessary data, with the Tax Identification Number (NIP) for the invoice being provided no later than when placing the order.
15.2. Agnostic is not responsible for incorrect or incomplete invoice data provided by the Customer.
15.3. In the case of corrective invoices, these Regulations constitute documentation agreeing on the terms of correction within the meaning of Article 29a, Section 13 of the Act of 11 March 2004 on Value Added Tax, and the customer's acceptance that the moment of reducing the VAT amount charged in the settlement for a given period is the moment Agnostic issues the corrective invoice. Agnostic issues a corrective invoice upon the return of the goods to Agnostic (return to the Agnostic showroom or warehouse), which constitutes fulfillment of the conditions for issuing a corrective invoice.

15. Issuing an invoice
15.1. In the event of a request for an invoice, the Customer shall provide the necessary data, with the Tax Identification Number (NIP) for the invoice being provided no later than when placing the order.
15.2. Agnostic is not responsible for incorrect or incomplete invoice data provided by the Customer.
15.3. In the case of corrective invoices, these Regulations constitute documentation agreeing on the terms of correction within the meaning of Article 29a, Section 13 of the Act of 11 March 2004 on Value Added Tax, and the customer's acceptance that the moment of reducing the VAT amount charged in the settlement for a given period is the moment Agnostic issues the corrective invoice. Agnostic issues a corrective invoice upon the return of the goods to Agnostic (return to the Agnostic showroom or warehouse), which constitutes fulfillment of the conditions for issuing a corrective invoice.
